Cunningham was arrested as part of Project Patton in June 2018 for his involvement in a criminal organization that trafficked firearms over the U.S. border.

He was found guilty on November 27, 2020 of:
- Firearms trafficking
- Possession of prohibited or restricted firearms
- Participate in the activities of a Criminal Organization for the purposes of enhancing the ability of the organization to commit the offence of importing firearms
He did not appear in court in May 2021 for his sentencing and was was sentenced to nine years in custody in absentia.
A Canada-wide warrant was issued on May 4, 2021 for his arrest.
